Work in Home Office and at Workplaces
Training in Occupational Safety and Emergency Situations Remotely, via Digital Means
This method is primarily intended for employees who work from home (Home Office), those who work at locations distant from the company’s main office, and those who work in isolated conditions and rarely visit the main office. However, any company can choose to apply this method of periodic training either partially or entirely online for all staff.
The only measure the company’s management needs to take to benefit from the advantages of digital training procedures is to mention in the Internal Regulations that this procedure applies, either partially or fully.
Description of the Process
Upon hiring, a Periodic Training Record is created, including the new employee's details, in PDF format, and the General Introductory Training begins. Both the General Introductory Training material and the Periodic Training Record will be sent by email to the new employee's address and to the designated person's or workplace supervisor's address.
The employee reads, understands, and signs the General Introductory Training and signs the Periodic Training Record at all points indicated in the signature field, following the instructions for opening the documents.
The periodic training proceeds as follows: The training topics and materials are sent to the trainee by email. The employee reads the training material, accepts the content, and signs it electronically.
The Periodic Training Record is sent to both the trainee and the trainer (usually the designated person within the company), also by email in PDF format, and is signed electronically in the indicated place(s).
Neither the employer nor the employee needs to have a personal electronic signature. This right is granted by us exclusively for the mentioned documents.
The legal basis for online SSM (Occupational Health and Safety) training and the application of electronic signatures includes the following legislative acts
1. Emergency Ordinance No. 36/2021:
→ This allows the use of advanced or qualified electronic signatures, accompanied by an electronic timestamp and the employer's qualified electronic seal, in the field of labor relations. The ordinance modifies the Labor Code, Law 81/2018 on Telework, and Law 319/2006 on Occupational Health and Safety.
→ It introduces the possibility of electronically signing individual employment contracts, additional acts, and other documents, as well as proofs of SSM training, which is particularly relevant for online SSM procedures.
2. Law No. 208/2021:
→ This law approves and amends Emergency Ordinance No. 36/2021, further solidifying the use of electronic signatures in labor relations and for documents related to SSM.
3. Law 81/2018 on Telework:
→ This law was amended to eliminate the requirement for specific training at the telework location and to include confidentiality requirements, thereby facilitating the application of online SSM training procedures.
